1. Agreement to Terms
By engaging with our services, scheduling an appointment, or making a payment, you (the "Client") expressly agree to be bound by these Terms and Conditions.
2. Services Provided
Drummond Risk & Resilience LLC provides risk assessment and consulting services. These assessments are based on visual inspections and information available at the time of the service. Client acknowledges that these services are advisory in nature.
3. Limitation of Liability and "As-Is" Assessments
The Client acknowledges and agrees to the following:

No Guarantee of Discovery: While Drummond Risk & Resilience LLC performs assessments with professional care, we do not guarantee that all possible risks, hazards, or defects will be identified.

Limited Scope: Our services are limited to the scope agreed upon at the time of booking. We are not responsible for any risks, conditions, or issues that were not found, were hidden, or were outside the specific areas assessed.

Assumption of Risk: The Client retains full responsibility for the safety of their premises and operations. Drummond Risk & Resilience LLC shall not be held liable for any injury, loss, or damage resulting from risks not identified during the assessment.
4. Confidentiality
Drummond Risk & Resilience LLC shall never disclose in any shape or form any confidential information deemed sensitive and not made available to the public.
The customer acknowledges the sensitivity of the data that will be assessed and acknowledges it is their responsibility to implement and manage access controls and security controls internally.

5. No Warranty and Hold Harmless

Advice is Supplemental: Any information, suggestions for controls, or risk identifications provided are for informational purposes only. They do not constitute legal, regulatory compliance, or financial advice.

Financial Disclaimer: Drummond Risk & Resilience LLC is not a financial advisor. No information provided during the course of service should be construed as financial planning, investment, or tax advice.

Liability & Indemnification: Drummond Risk & Resilience LLC shall not be liable to the Client for any loss incurred in the performance of the services hereunder unless caused by the Company’s intentional misconduct. The Client agrees, at its sole defense, to indemnify and defend the Company from and against any damages, claims or suits by third parties against the Company arising from the performance of the Company’s Services hereunder unless caused by the Company’s intentional misconduct.

Client Decision-Making: The final decision to implement any recommended control rests solely with the Client. By using these services, the Client agrees to hold Drummond Risk & Resilience LLC harmless from any legal claims, damages, or losses resulting from the implementation or failure to implement any suggestions provided.
6. Maximum Liability
To the fullest extent permitted by law, the total liability of Drummond Risk & Resilience LLC for any claim arising out of our services shall not exceed the total amount paid by the Client for that specific service.
7. Right to Revoke or Cancel
Drummond Risk & Resilience LLC reserves the right to revoke, cancel, or terminate any service at any time, for any reason, without prior notice. If we cancel a service already paid for (and the cancellation is not due to a breach by the Client), a pro-rated refund may be issued at our discretion.
8. Client Responsibilities

Financial Responsibility: The Client acknowledges that it is their sole responsibility to evaluate the financial impact of any changes, implementations, or mitigations made following our assessment. The Client must ensure they have the financial capacity and resources to handle any such changes, and Drummond Risk & Resilience LLC is not responsible for any budgetary overruns or financial losses resulting from the Client’s operational decisions.
9. Governing Law and Venue
These terms are governed by the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes or legal proceedings shall be resolved exclusively in the courts of Anne Arundel County, Maryland. Services are deemed to be rendered from Maryland.
